Proteger ou não proteger: o dilema da propriedade dos dados

Resumo

Este artigo aborda o debate sobre a propriedade dos dados no contexto da economia digital e a importância crescente dos dados para a inovação tecnológica e o desenvolvimento econômico. O artigo discute a dupla natureza dos dados: embora os dados em si não sejam diretamente protegíeis como propriedade, os dados estruturados ou processados podem ser indiretamente protegidos por direitos de propriedade intelectual ou por segredos comerciais. Examina também o surgimento de teorias sobre a propriedade dos dados, motivadas pela falta de clareza jurídica e pelos elevados custos de transação na economia digital.

Ao fazê-lo, o autor apresenta duas posições principais: uma que defende a proteção dos dados ao abrigo de um regime de propriedade privada, argumentando que tal encorajaria o investimento e garantiria direitos exclusivos aos proprietários, e outra que defende um acesso mais aberto aos dados, favorecendo a reutilização e o desenvolvimento tecnológico coletivo. Com o aumento do volume de dados e da sua utilização em tecnologias como a inteligência artificial, este dilema torna-se cada vez mais relevante.
