Employment arbitration in the U.S.A.
Abstract
This article examines the general characteristics of employment arbitration in the United States of America and identifies main commonalities and differences vis-à-vis court conducted proceedings. It also analyses how both systems relate to each other and their compatibility, especially concerning the scope and limitations of judicial review with respect to arbitral proceedings and awards. To that end, this paper addresses the main statutory regulations and judicial decisions that govern employment arbitration, as well as some statistics drawn from arbitral cases. Finally, this article opens the debate on the factual achievements and shortcomings of both employment disputes resolution systems, as a manner of setting a basis for discussion of fostering industrial relations.
