The satisfaction of the forced shares in the Spanish Civil Code. Case law overview
Abstract
The general rule in Spanish law is that forced heirs, descendants or ascendants, receive assets from the estate in payment of their right; and, as far as the widowed spouse is concerned, the forced inheritance right is specified in a usufruct over a part of the estate. This paper examines, firstly, the exceptional cases in which the testator can ensure that the forced heirs receive money that is not inherited and, secondly, the ways in which the widowed spouse's usufruct can be exchanged for a different form of entitlement. Finally, there are also a number of pages focusing on the possibility recognized to the testator by article 831 of the Civil Code of entrusting the widowed spouse with the power to distribute the estate as he or she sees fit among the common descendants, and the extent to which this power can affect the forced shares of the latter.
