Abstract

In the United States, the habeas corpus is, essentially, a civil action filed before the federal courts, aimed at the review of the criminal convictions ordered by the local courts when the latter have incurred in a violation of the Constitution or of the federal laws. It consists in the collateral review of criminal convictions, which is also exercised to review the convictions ordered by the federal courts, although this function is less widespread. This paper analises said action and examines the possibilities of its adoption in Argentina
