The U.S. Supreme Court – 2000-2005
Abstract
This article analyzes the most important cases decided by the Supreme Court of the United States between 2000 and 2005. These are the last five years of the so-called “Rehnquist Court,” that is, of the Supreme Court under Chief Justice William Rehnquist. This is the reason for highlighting Rehnquist had on the Court. Mention is also made of the significant role played by Justices Anthony Kennedy and Sandra Day O’Connor. These two moderate conservatives have exercised a kind of “arbitration” between the conservative and the liberal justices with their swing votes. One of the most remarkable facts of this period, as a result of that arbitration, is that the Supreme Court was ideologically balanced. All this prevents placing the Supreme Court of this five-year period under a specific political sign, since, in the general balance, the victories between liberals and conservatives are distributed proportionally. As a working method, the decisions analyzed are classified based on the articles and amendments of the United States Constitution that the Court understood were especially applicable in each case.
