The text analyzes the reparation of damage to crime victims as an integral part of restorative justice. It addresses Luigi Ferrajoli's theory of criminal guarantees with a victimological approach, which allows to review the accusatory criminal system in force in Mexico as an instrument that places the rights of the accused and the victim in balance. Furthermore, it analyzes the role of the State in relation to access to justice, particularly with regard to secondary victimization or institutional victimization, to finally address the issue of the effectiveness of the law in the face of reparation of damage.
