Los desafíos de la propiedad intelectual en las expresiones tradicionales de los pueblos indígenas
Resumen
Los conocimientos tradicionales —que engloban la sabiduría, la experiencia, las aptitudes y las prácticas desarrolladas, mantenidas y transmitidas de generación en generación— tienen un valor intrínseco que trasciende lo meramente económico. Este artículo examina de manera integral los desafíos y tendencias teóricas que enfrentan los sistemas de protección de propiedad intelectual para la protección de las expresiones tradicionales de los pueblos indígenas y los conocimientos tradicionales a nivel mundial. Para ello, se emplea una investigación documental sistemática que incorpora el método dogmático jurídico y el derecho comparado. La interrogante que orienta el desarrollo del trabajo es cuáles son los desafíos y tendencias teóricas en la protección de la propiedad intelectual de las expresiones tradicionales de los pueblos indígenas. Se presentan como resultados los desafíos que limitan la protección de la propiedad intelectual de las expresiones tradicionales de los pueblos indígenas y las tendencias teóricas que se utilizan para su protección. De esta investigación se puede concluir que la protección de la propiedad intelectual contiene barreras históricas inherentes a los pueblos indígenas arraigadas en la legislación internacional y nacional y que surgen desafíos —como las consecuencias del colonialismo, la globalización y el desarrollo industrial— que resultan insuperables más allá de las voluntades de los Estados. Se conciben tendencias teóricas-metodológicas alternativas como el enfoque sui generis para la protección de los conocimientos tradicionales y las expresiones culturales tradicionales, además de la cogestión del legado cultural de los pueblos indígenas, la autorregulación y el reconocimiento del derecho consuetudinario, resultando importante la garantía de justicia social, la equidad, la preservación del patrimonio y el fortalecimiento de la identidad cultural de los indígenas.
