The Rule of Law as an idea of society

Abstract

The Rule of Law must not be understood exclusively as a set of formal requirements, but also as a way of understanding the concept of law and legal theory, and more generally as a social practice that makes possible the respect of legal validity. Nevertheless, the Rule of Law does not meet all the components of the idea of law. Positive law claims to be right in content, even if this claim is not always satisfied. The Rule of Law and the claim of justice are necessary and ideal requirements of the concept of law.

Profesor emérito de Filosofía del Derecho (Universidad de Palermo, Italia). Exdirector del Dipartimento di Studi su Politica, Diritto e Società (1986-1993). Vicepresidente del Comitato Científico de la Società italiana di filosofia del Diritto e Filosofia Politica. Codirector de la colección “Recta Ratio” (Giappichelli, Torino), de la revista Ragion pratica y de Ars Interpretandi. Annuario di ermeneutica giuridica. Excoordinador del doctorado Derechos Humanos: evolución, tutela y límites (Universidad de Palermo y Universidad de Pádova, Italia) y director de la Escuela doctorale en Derecho supranationale y derecho nationale. Expresidente de la Società italiana di Filosofia del diritto (2010-2014). Ha publicado numerosos libros y artículos de su especialidad, recibiendo en 2000, junto con el prof.  Zaccaria, el premio del Club de Juristas al mejor libro jurídico italiano del año.
