Between Algorithms and Rights: A Comparative Analysis of the Use of Copyrighted Works for Training Artificial Intelligence in Latin America. A Study Based on AIPPI Questionnaire Q295

This article analyzes the current state of copyright law in relation to the use of protected works for the training of artificial intelligence (AI) systems in Latin America. Based on a comparative study of national responses to AIPPI’s Q295 Questionnaire — submitted by Paraguay, Argentina, Mexico, Chile, Brazil, and the regional group of Central America and the Caribbean — the paper identifies points of convergence, legal gaps, and emerging trends. It shows that, except for Brazil, most countries lack specific legislation, operate under outdated frameworks, and have not adopted functional exceptions to legally enable AI training. The article proposes a minimum agenda for regional legal harmonization that balances copyright protection with the promotion of innovation.
