Who’s Who? Creation, Teaching, Technification and Criticism of Law in “Legal Culture(s)”

This paper examines the notion of “legal culture” based on the contributions of Giovanni Tarello and Lawrence Friedman, who distinguish between “internal” and “external” legal culture. Emphasising this division, an alternative approach based on the taxonomy of discourses proposed by Paolo Comanducci is proposed. The central hypothesis maintains that legal culture develops mainly through discourses that allow us to identify subjects who perform a set of roles, with varying degrees of relevance in their contributions. Based on this criterion, four fundamental roles are proposed, although this list is not exhaustive: the creative role, linked to normative production; the didactic role, oriented towards the transmission of legal knowledge; the technical role, responsible for adapting claims about the law; and the critical role, which promotes adjustments and reforms in the system. The analysis shows that the boundaries between internal and external legal culture are permeable, as non-professional actors also influence the configuration of law through discourses that ultimately prove relevant. Consequently, the traditional view that attributes the monopoly of legal culture to technicians is questioned, highlighting the importance of integrating the participation of external actors to understand the legal phenomenon in its entirety.
