Post mortem Adoption Rulings, the Best Interests of the Child, and Property Rights: A Critical Analysis of Recent Argentine Case Law

This paper analyzes the ruling issued on July 11, 2023, by Family Court No. 1 of Tigre (Buenos Aires Province), which granted full adoption of two children to their guardians, one of whom had recently passed away. This decision, part of a jurisprudential line inaugurated by the Supreme Court of Justice of the Nation in 2012, presents certain particular features that confer upon it a singular status. The following analysis seeks to reconstruct these specificities within a broader body of case law developed over more than nine years, and to assess the extent to which they contribute to strengthening the standards of comprehensive protection of the rights of children and adolescents in post mortem adoption proceedings. It is argued that this figure, a creation of judicial practice, while centered on the best interests of the child and the preservation of socio-affective bonds, still presents gaps regarding the articulation with property and inheritance rights. This situation calls for a critical review aimed at overcoming stereotypes and preventing the invisibilization of material dimensions that are essential for the well-being and future development of the children involved.
