Guidelines for Comparing Claims in Patent Infringement Cases in the Andean Community

This paper explores the legal criteria that must be considered when analyzing possible patent infringements within the framework of the Andean Community. From a dogmatic and caselaw approach, four fundamental steps are proposed to structure this analysis: the identification of acts of infringement, the verification of the existence of flexibilities that legitimize unauthorized use, the delimitation of the scope of the patent through its claims, and the comparison of these with the technical elements of the product or the procedure accused of infringement. Special attention is devoted to the jurisprudential evolution surrounding claim interpretation, particularly the introduction of the doctrine of equivalents in the Andean region. The paper is based on cases decided by authorities such as INDECOPI in Peru and the Superintendence of Industry and Commerce in Colombia, with the aim of illustrating how legal operators can apply these criteria in concrete contexts.
