The Duration of the Economic Rights in Copyright Protection for Photographic Works in Argentina: Normative Analysis and Interpretation in light of International Treaties

This thesis analyzes the legal framework governing the duration of the economic rights in copyright protection for photographic works in Argentina, within a regulatory context marked by the coexistence of domestic norms and international commitments that exhibit significant discrepancies. In particular, it examines the divergence between the twenty-year term from publication established in Article 34 of Law No. 11723 and the longer protection periods set forth in international intellectual property treaties ratified by Argentina, which hold a higher normative hierarchy. The lack of harmonization has given rise to situations of legal uncertainty, as evidenced by the case Yabkowski v. AFA, which illustrates the effects of a regulatory regime that grants national authors a lower level of protection than that afforded by current international standards. Through an analysis of national and international legal frameworks, doctrinal and jurisprudential sources, legislative history and reform proposals, WIPO interpretative guides, and comparative law, this thesis proposes a normative construction that is consistent with the existing legal order, together with a legislative reform proposal aimed at aligning Argentine law with international standards in the field of copyright protection for photographic works.
