Artistic Names or Pseudonyms: Legal Nature — Personal Right and/or Exclusive Right?

The purpose of this paper is to analyze the legal feasibility of third parties, unrelated to the creator and original holder of an artistic name or pseudonym, making use of and exploiting such name once its holder has passed away. The study focuses on the name adopted by a natural person as a means of identification in the course of his or her artistic and/or cultural activities.
This issue arises because, following the death of artists or individuals who identified themselves with a “name” (commonly referred to as an “artistic name” or “pseudonym”) for the development and exercise of their artistic activities, unauthorized third parties economically exploit an iconic element that identified a deceased person, treating it merely as an economic asset, detached from its nature as an inalienable and extra-patrimonial personality right.
Consequently, such third parties make exclusive use of and derive economic benefit from a right intrinsically linked to the personal sphere of its creator. Depending on the fame or notoriety achieved by the creator and holder in the exercise of his or her artistic activity, such exploitation may generate substantial profits by allowing the use of artistic names or pseudonyms; or, alternatively, by prohibiting their use regardless of the intended purpose.
Therefore, it is essential to determine whether, based on the legal nature of the artistic name or pseudonym and in accordance with its regulation in our country (through a comparative analysis of other Latin American jurisdictions), it is possible to provide a different or broader normative treatment than that currently in force in the country, bearing in mind, fundamentally, that an artistic name or pseudonym constitutes a personality right.
