The Legal Nature of Conventionality Control

Abstract

This study examines the doctrine of conventionality control as a legal tool aimed at ensuring the conformity of domestic law with the American Convention on Human Rights. The article is structured around a twofold inquiry: in what sense conventionality control constitutes a legal obligation, and what the nature of its minimum obligatory content is. Based on an analysis of Article 38 of the Statute of the International Court of Justice, as well as Articles 31 and 32 of the Vienna Convention on the Law of Treaties and the evolution of the Inter-American Court’s case law, it is argued that its legal force does not derive from an express conventional provision, but rather from the judicial decisions of that tribunal. This circumstance explains both the progressive expansion of its scope and the difficulties involved in delimiting its content. Given that this is a tool operating within the Inter-American system, it is necessary to clarify its content. In this regard, the article’s main contribution lies in offering a systematic reconstruction of this obligation by specifying its subjects, its object, and the legal relationship that structures it.
