Abstract

Nobody questions the validity of current national and international human rights. In this context, one of the major aspects of human rights is its basis in the human being or dignity. But although it seems that this conception is unanimous and widely accepted, we will see that it is not, and we will distinguish the variety of views that have emerged regarding the philosophical basis of human rights. Through this intervention, we seek to analyze, under the light of law philosophy, an appropriate foundation for human rights, especially through the work and thought of the distinguished German philosopher Robert Spaeman, whose conception of human dignity gives a satisfactory answer to this matter so relevant to the juridical thought.
