Code of Ethics
The Revista Jurídica Austral adheres to the Code of Conduct and Best Practice Guidelines for Journal Editors established by the Committee on Publication Ethics (COPE), a forum for editors of peer-reviewed scholarly publications whose primary objective is to promote integrity in academic research and its dissemination.
To ensure compliance with these principles throughout the review, editorial, and publication processes, the Revista Jurídica Austral requires authors, reviewers, and members of the Editorial Board to observe the ethical policies and best editorial practices set forth below. Manuscripts that fail to comply with these ethical standards will not be considered for publication.
Author’s responsibility
Manuscripts submitted to the Revista Jurídica Austral must be original, unpublished works that demonstrate a high standard of academic quality and scholarly interest. Submissions must also comply with the publication guidelines detailed in the Submissions section.
Authors are expected to have made a significant contribution to the development of the research and are required to specify the nature of their contributions. This information must be included at the end of the manuscript, as required in the Authorship roles notice. Authors must also cite appropriate and relevant bibliography supporting the results presented in their manuscript.
At the time of submission, all authors must agree to the terms and conditions established in the originality and copyright policies of the Revista Jurídica Austral, which are described in the About the Journal section.
When the study has been funded by an institution or organization, authors must clearly indicate the sources of financial support.
Authors must notify the editor of any potential conflicts of interest with members of the Editorial Board or with potential external reviewers.
Authors are expected to give due consideration to the evaluations provided by referees during the peer review process and to revise their manuscripts in accordance with the reviewers’ recommendations when requested.
If errors are detected, authors are required to provide retractions or corrections when requested by the Editorial Board.
The Revista Jurídica Austral rejects any fabrication or malicious manipulation of data. Authors must therefore avoid plagiarism in all its forms and maintain records of the data generated through their research.
Transparency in the Use of AI by Authors: The Committee on Publication Ethics stipulates that when researchers use artificial intelligence tools during the writing process, such use must be clearly disclosed in the manuscript, specifying how the AI was used and identifying the specific tool employed.
The use of artificial intelligence does not exempt researchers from full responsibility for the content of their publication. Human authors retain full accountability and must ensure the integrity and originality of all material presented, including any portions generated with the assistance of AI.
Reviewer’s responsibility
All research articles published in the Revista Jurídica Austral undergo peer review by experts in the relevant field under a double-blind review process, as described in the About the Journal section.
Reviewers are required to evaluate manuscripts in a critical, objective, and impartial manner and to inform the Editorial Board of any potential conflicts of interest. They must also comply with the journal’s editorial policies and with this Code of Ethics and Best Editorial Practices.
Reviewers are also expected to notify the Editorial Board of any potential instances of misconduct or unethical practices they may detect during the review process, so that the Editorial Board may assess the case and take the appropriate measures.
Finally, reviewers are expected to comply with the deadlines established by the journal in order to avoid delays in the publication process.
Editor’s responsability
Manuscripts submitted to the Revista Jurídica Austral are received and examined by the Editorial Board, which verifies their relevance to the journal’s scope and subject matter. In addition, the Editorial Board assesses the originality, significance, academic quality, and scholarly interest of the submissions and determines whether a manuscript should be accepted or rejected. In the case of research articles, manuscripts are sent to the peer-review process.
The Editorial Board is required to act impartially in the manuscript selection process and is committed to maintaining the confidentiality of the peer-review process, as well as the anonymity of authors, until the manuscripts have been accepted for publication.
The Editorial Board may directly reject submitted manuscripts if it determines that they do not meet the minimum requirements or are not prepared in accordance with the journal’s publication guidelines.
In the event of a conflict of interest between an author and an editor, the editor concerned will not participate in the review or decision-making processes.
Furthermore, the Editorial Board reviews manuscripts using the anti-plagiarism software Compilatio Magister+, which detects textual similarities, potentially plagiarized content once translated, text generated by artificial intelligence tools (such as ChatGPT, Gemini, and YouChat), as well as paraphrasing or attempts to modify text in order to conceal similarities.
The Editorial Board also issues authorship and review certificates upon request.
In cases where misconduct is detected, the Editorial Board and the Editors-in-Chief will follow the recommendations of the Committee on Publication Ethics. The situation will be analyzed and a resolution will be issued. If malpractice is confirmed, the journal may decide to retract the publication or request the necessary corrections.
Conflicts of Interest
Conflicts of interest arise when there is a direct relationship or collaboration among participants in the editorial process (including authors, reviewers, copy editors, translators, members of the editorial team, among others), or when the Editorial Board considers that it may not be able to evaluate a manuscript objectively.
If no conflict of interest exists, authors must explicitly state this at the end of the manuscript, as indicated in the Submissions section.
Allegations of Misconduct and Resolution of Ethical Issues
The Editorial Board receives any allegations of misconduct or ethical concerns through its official email address (revistajuridicaaustral@austral.edu.ar).
If the allegation concerns an article that has not yet been published, the publication process will be suspended until the matter has been resolved.
The Editorial Board and the Editors-in-Chief will evaluate each case objectively. If misconduct is confirmed, the manuscript may be rejected.
If an allegation concerns a work that has already been published and misconduct is verified, the Editorial Board may request a retraction and will report the issue on the journal’s website.
