This paper analyzes State liability for harm suffered by persons deprived of their liberty, based on the specific duties arising from the special relationship of subjection and the special position of guarantor assumed by the State with respect to persons under its custody. In particular, it examines the development of the case law of the Supreme Court of Argentina through the “Badín”, “Gatica”, and “Sosa” decisions, in which the State’s duties of custody, protection, and prevention are progressively defined and strengthened. The analysis shows that State liability does not necessarily depend on the direct involvement of State agents in causing the harm, but may arise from the breach of positive duties aimed at preventing risks inherent to the context of incarceration. The paper also addresses the relevance of the conduct of third parties and of the victim themselves, as well as the extension of protective duties to persons who, although not deprived of their liberty, enter penitentiary facilities under conditions regulated and controlled by the Administration. Finally, it argues that the special position of guarantor does not transform the State into a universal insurer, but rather intensifies the duties whose breach may constitute an improper provision of the public service and give rise to State liability.
