This commentary analyzes the ruling of the Argentine Supreme Court in Torres Abad (Fallos: 349:407), which declared, of its own motion, the unconstitutionality of the exceptions to consent set forth in sections 5.2.b and 11.3.b and c of Law 25326 regarding the transfer of personal data between State agencies. It argues that the true contribution of the decision does not lie in the declaration of unconstitutionality itself, but in the implicit reception of the purpose limitation principle as an autonomous constitutional requirement derived from section 43, third paragraph, of the Argentine Constitution. The paper examines the normative architecture of the holding, the interpretive methodology employed and its shortcomings, and the projection of the new standard onto inter-administrative data-sharing agreements and the use of artificial intelligence by the State. It concludes that legislative reform is required to regulate inter-administrative data flows with the specificity the precedent demands.
