Abstract

This paper reviews the jurisprudence of the Supreme Court of Justice of the Nation on res judicata, also in its relationship with the principle of procedural preclusion. After examining specific cases in which the court has used this concept for its resolution, it is questioned whether, on occasion, the maintenance of res judicata cannot contradict constitutional guarantees or the interest of the community.
