Gobernanza global de los marginados: soberanía, migración y cambio climático

El aumento del nivel del mar a causa del cambio climático y la posible inundación total del territorio de algunos Pequeños Estados Insulares en Desarrollo (PEID, por sus siglas en inglés) plantea varios interrogantes relativos a la migración de su población a otros Estados, la continuidad de su existencia sin territorio y las acciones de la comunidad internacional para abordar esta problemática. En el presente trabajo se analizan los mecanismos de gobernanza global reflejados en las COP26 hasta la COP29, relacionados con la migración ambiental para este grupo de Estados. Asimismo, se estudia el caso del Tratado de la Unión Falepili firmado en noviembre de 2023 entre Australia y Tuvalu, a través del cual las partes propusieron regular lo concerniente al desplazamiento de la población tuvalense debido a cuestiones climáticas. Los hallazgos evidencian una paradoja estructural en la gobernanza climática: mientras los organismos internacionales reconocen formalmente la migración por causas climáticas, no ofrecen mecanismos vinculantes para proteger la integridad territorial de los SIDS ante riesgos existenciales. Finalmente, se propone fortalecer la gobernanza global a través del establecimiento de un marco global que incorpore estándares internacionales, anclados en los derechos de las poblaciones vulnerables y el deber de cooperación internacional al tratarse de una cuestión de supervivencia global.
